Terms of Service

These terms are the agreement between you and Magnova Pty Ltd for using Magnova AI App Builder. By creating an account or using the service you agree to them.

Who we are

Magnova AI App Builder ("Magnova AI", "we", "us") is run by Magnova Pty Ltd, an Australian company. You can reach us at support@magnified.news, and write to legal@magnified.news about legal matters.

The service

Magnova AI uses artificial intelligence to write and change software from your instructions, runs it for you, and lets you publish it on the web or export it. What the AI writes can contain mistakes, and the same request can give different results. Review and test what it builds, and take responsibility for what you publish or ship.

Your account

You need an account to use Magnova AI, and you must be at least 13 years old to have one. You create it with an email address, which we confirm with a code we email you, or with your Apple or Google account. Give us accurate details, and keep your inbox and your Apple or Google account to yourself: what is done through your account is your responsibility. Creating an account means you accept these terms and the privacy policy. You can delete your account at any time in Settings.

Your content and what you build

You own what you create with Magnova AI, subject to the terms of the open-source packages included in generated apps. You are responsible for the instructions you give and for having the right to use any content you add. You let us store and process your instructions, files and conversations, and send them to the services we use (see who processes it), only to run the service for you.

Acceptable use

You agree to follow the Acceptable Use Policy. Do not use Magnova AI to build software that is illegal, harmful, deceptive or that infringes anyone's rights.

Credits and subscriptions

AI usage is paid for with credits. New accounts can receive starter credit, once per person: it is granted once per email mailbox, Apple account or Google account, and deleting an account does not make that person eligible for it again. Paid plans renew monthly through your Apple or Google account until you cancel there, and include credits and the ability to export. Credit is a unit we use to pay for AI usage in Magnova AI: the amount shown is an amount of credit, how fast it is used depends on the AI model you choose for each app and on how much work it does, and it is not a dollar value of any third-party service. Credits have no cash value, and unused monthly credits do not roll over unless the plan says so. Top-up credits do not expire. Plans may also pace how much you can use in a session and in a week. Refunds follow the store's policy.

Exporting and publishing to the stores

Exporting gives you a standard project. Publishing it to the App Store or Google Play is your responsibility, including their review rules, your developer account and your app's own privacy policy.

Apps you publish on the web

Magnova AI can put an app you built on the web at an address of its own, or at a domain you connect. You are responsible for what you publish. You must not publish anything that impersonates a person, company or service, collects passwords or payment details under false pretenses, is unlawful, harmful or misleading, or infringes someone's rights. Anyone can report a published app, and we may take an app offline or disconnect a domain at any time, with or without notice, if we believe it breaks these terms. Published apps are public: do not include anything in an app that you do not want the public to see.

Other companies' services

Magnova AI relies on services from others, among them AI models, Apple and Google for sign-in and purchases, a purchases provider, an email provider and a hosting provider. Their own terms apply to the parts they provide, and we are not responsible for them.

Our service and our name

The service, its design and the Magnova AI name belong to us and our licensors. While you follow these terms we give you a personal, non-exclusive right to use the service. That does not give you any right to our name or logos.

Ending your use

You can stop using Magnova AI at any time and delete your account in Settings. We may suspend or end an account, and take down what it published, if it breaks these terms or the Acceptable Use Policy or puts other people or the service at risk. When an account ends its data is deleted as the privacy policy describes.

Availability and changes

The service is provided as it is. We may change or discontinue features, and we may suspend accounts that abuse the service. We will give notice of material changes to paid plans.

Liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits a liability that the law does not allow to be limited.

If something goes wrong

Please write to legal@magnified.news first, say what the problem is and what would put it right, and give us 30 days to sort it out with you before you start any formal proceedings. This does not stop either of us from going to a court to stop something urgent, such as someone using the other's rights without permission.

Governing law

These terms are governed by the laws of New South Wales, Australia. Nothing in them excludes, restricts or changes any right you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or under any other law that cannot be excluded, restricted or changed by agreement.

Changes to these terms

We may update these terms. The date at the top says when they last changed, and if a change matters to what you can do or pay we will tell you in the app or by email. Using Magnova AI after a change means you accept it.
